Terms of Service

These terms govern your use of the Catalyst website and platform (the “Service”). By creating an account or using the Service you agree to them. If you are using the Service for a company, you agree on its behalf.

1. The Service

Catalyst is a marketing platform whose AI agents help you discover trends, create content, forecast performance and launch and optimise campaigns on the channels you connect. Features vary by plan, as described on our pricing page.

2. Your account

You must give accurate information, keep your login details confidential and be at least 18 years old. You are responsible for activity in your workspace, including activity by people you invite to it.

3. Plans, billing and cancellation

• Paid plans start at $99 per month. Starter and Growth are billed monthly in advance, in US dollars, excluding taxes.
• Plans renew automatically each month until cancelled. You can cancel at any time; your plan stays active until the end of the period you have paid for, and fees already paid are not refunded except where the law requires.
• Upgrades take effect immediately and are pro-rated. Downgrades take effect at the next renewal.
• We may change prices with at least 30 days’ notice. The new price applies from your next renewal after the notice period.
• Advertising spend is charged by each platform directly to your own ad accounts and is not part of our fees.

4. Your content

You keep all rights in the material you import and, as between you and us, in the content the Service generates for you. You give us a licence to host and process that content only as needed to provide the Service. You are responsible for having the rights to what you import.

5. Connected channels and your spend

When you connect a channel you authorise Catalyst to act on that account within the permissions and limits you set, including publishing content and adjusting budgets. You are responsible for your spend caps, for reviewing what you approve, and for complying with each platform’s advertising policies and with the laws that apply to your marketing.

6. AI-generated output

The Service produces content, forecasts and recommendations using AI. Output may be inaccurate, incomplete or similar to content produced for others. Forecasts and simulations are estimates, not guarantees of results. You are responsible for reviewing output before you publish it, including any claims it makes about your products.

7. Acceptable use

You agree not to use the Service to break the law, infringe others’ rights, publish deceptive, hateful or harmful content, send spam, attempt to gain unauthorised access to any system, or reverse engineer or resell the Service without our written consent.

8. Our intellectual property

The Service, including its software, design and brand, belongs to Catalyst. These terms give you a right to use it during your subscription and nothing more.

9. Suspension and termination

You may stop using the Service at any time. We may suspend or close an account that breaches these terms or creates risk for other customers or for the platforms we connect to, with notice where practical. After closure you have 30 days to export your content before it is scheduled for deletion.

10. Disclaimers

The Service is provided “as is”. To the extent the law allows, we disclaim all implied warranties, including that the Service will be uninterrupted or error-free or that it will achieve any particular marketing result.

11. Limitation of liability

To the extent the law allows, Catalyst is not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

12. Changes to these terms

We may update these terms. We will post the new version here and give account holders at least 30 days’ notice of material changes. Continuing to use the Service after a change takes effect means you accept it.

13. Governing law

These terms are governed by the laws of the place where Catalyst is established, and the courts of that place have jurisdiction, without affecting any consumer rights you have where you live.
